Confidentiality and Non-Disclosure Statement Governing Records Retained by Forsetyrs Legion ALC All relevant parties are hereby advised that Forsetyrs Legion ALC, a duly recognized 501(c)(3) nonprofit organization operating under the laws of the United States of America, specifically those of the State of South Carolina, maintains strict and unwavering adherence to the principles of confidentiality, privacy, and the protection of sensitive information entrusted to its custody. In accordance with its founding mission and obligations,
Forsetyrs Legion ALC declares the following terms and provisions regarding the classification, handling, and dissemination of such records: Classification of Records: Any and all documentation, written correspondence, records, or data, whether in electronic, physical, or otherwise tangible form, relating to individuals under the age of majority, as defined by South Carolina Code of Laws § 15-1-320, or individuals classified under any protected status pursuant to applicable state or federal law, shall be deemed strictly confidential and irrevocably classified. Said records shall not be subject to disclosure, dissemination, or release under any circumstances absent explicit legal justification pursuant to Paragraph 4 herein.
Exemption from Subpoena Power: Forsetyrs Legion ALC asserts that all classified records under its custody are fully exempt from the subpoena powers and processes of any judicial or quasi-judicial tribunal, whether within the jurisdiction of the State of South Carolina or any other state, pursuant to the doctrine of privileges recognized by case law and statutory enactment, including but not limited to: The legal principle of undue burden, as recognized under Rule 45(d)(3) of the Federal Rules of Civil Procedure, which permits the quashing or modification of subpoenas imposing an oppressive or unreasonable obligation on the recipient. The assertion of a qualified privilege under South Carolina Evidence Rules § 501, encompassing the protection of sensitive and privileged communications that pertain to vulnerable individuals. Preemption by Federal Statutes: Forsetyrs Legion ALC acknowledges the governing authority of federal statutory enactments, including but not limited to: 42 U.S.C. § 290dd-2 (Confidentiality of Substance Use Disorder Records), which explicitly prohibits the disclosure of any identifying information absent express written consent or a specific court order accompanied by a showing of good cause. 5 U.S.C. § 552(b)(6), an exemption under the Freedom of Information Act (FOIA), ensuring the non-disclosure of personnel, medical, and similar files where such disclosure would constitute an unwarranted invasion of privacy.
Mandatory Reporting Compliance: Notwithstanding the foregoing, Forsetyrs Legion ALC acknowledges its designation as a mandatory reporter under South Carolina Code of Laws § 63-7-310 and related statutes. As such, the organization is obligated to report any reasonable suspicion of abuse, neglect, or exploitation of minors to the South Carolina Department of Social Services (SCDSS) and reserves the right to disclose information solely as mandated under such statutory obligations.
Finality of Disclaimer: The provisions articulated in this statement shall be binding and enforceable to the maximum extent permissible under applicable law. Any attempt to challenge, override, or invalidate the protections articulated herein shall be deemed null and void unless accompanied by an adjudication of enforceability by a competent court of jurisdiction under a standard of strict scrutiny.
